EXECUTIVE ORDER NO. 40 Series of 2020

AN ORDER PROVIDING FOR THE SUSPENSION OF BICYCLE REGISTRATION, BICYCLE REGISTRATION FEES, AND ALLOWING THE USE OF BICYCLE LANES IN THE CITY OF DAVAO

WHEREAS, pursuant to the DILG Memorandum Circular enjoining all Local Government Units to establish a network of cycling lanes and walking paths to support people’s mobility during this time of pandemic, the City Government of Davao has established Bicycle Lanes around the city streets;

WHEREAS, as a consequence of the COVID-19 pandemic, Davaoeños who find it hard to traverse the City due to limited public transportation have resorted to using bicycles as an alternative mode of travel;

WHEREAS, during the Joint Committee Hearing by the Davao City Council Committees on Peace and Public Safety and Transportation and Communication last June 10 and 15, 2020, it was brought to the attention of the body that the Traffic Code of Davao and the existing Bicycle Ordinance stipulate contradicting provisions regarding bicycle registration and registration fees, among others;

WHEREAS, the temporary suspension of the implementation of some provisions of the two ordinances would allow Davaoeños the use of the bike lanes without fear of penalty for non-registration and etc., until the two ordinances have been harmonized;

NOW, THEREFORE, I, SARA Z. DUTERTE, Mayor of the City of Davao, by virtue of the powers vested in me by law, do hereby order the following:

SECTION 1. TEMPORARY SUSPENSION OF THE IMPLEMENTATION OF THE ORDINANCE FOR THE COMPREHENSIVE TRANSPORT AND TRAFFIC CODE PERTAINING TO BICYCLES. The following Sections of the Traffic Code shall be suspended:

• Section 79. License Required

• Section 80. Registration

• Section 81. Attachment of License Plate

• Section 84. Penalties

SECTION 2. TEMPORARY SUSPENSION OF THE IMPLEMENTATION OF THE BICYCLE ORDINANCE OF DAVAO CITY. The following Sections of the Bicycle Ordinance shall be suspended:

• Section 7. Bicycle User Registration

• Section 12. Bicycle Registration

• Section 32. Penalties

    SECTION 3. DURATION. The temporary suspension of the implementation shall last until the State of Public Health Emergency is lifted, or until the amendments harmonizing the Traffic Code and the Bicycle Ordinance have been approved, or unless otherwise lifted by the Office of the City Mayor.

SECTION 4. BICYCLE LANES. Bicycle lanes marked by the City Transportation and Traffic Management Office may be used by all persons on bicycles, except pedal-operated passenger tricycles for hire. No motorized transport vehicle may use, park or stop on the marked bicycle lanes. Pedestrians are urged to use the sidewalks and not the bicycle lanes to give way to persons on bicycles.

SECTION 5. SAFETY STANDARDS.

1. Persons on bicycles must wear a helmet, headgear or protective head covering.

2. Persons on bicycles at night must have reflectors, or headlights, or rear lights or any other warning lights attached to the bicycle or on his/her person.

3. Bicycles made for single riders should not carry more than one passenger at a time. Tandem bicycles shall be allowed only for the capacity for which it is made;

4. Riders with cargo shall not carry the same with their hands while operating the bike, nor place the same on their handlebars or along the wheelbase.

5. Cargo must be placed in a wearable backpack or on a basket or carrier in front of the handlebars or behind the seat.

SECTION 6. SEPARABILITY CLAUSE. If for any reason any Section of this Executive Order is declared unconstitutional or invalid, the other sections or provisions hereof which are not affected thereby, shall continue to be in full force and effect.

SECTION 7. EFFECTIVITY. This order shall take effect immediately. Done this 18th of June 2020 in Davao City, Philippines.
